Some projects have a special provision for TERO in their contracts. This provision applies to projects within the legal or historic boundaries of Indian Reservations.
The Special Provisions can vary slightly depending on the location of the project and scope of work. They can include some or all of the following: an Indian Preference Hiring Goal, TERO Employment Fee, Other Special Fees and/or a need for Compliance Plan to be negotiated between the Contractor and the Tribe.
When a project is let, a letter is sent to the Contractor and the Tribal TERO office notifying them of the Special Provision requirements and whether a Compliance Plan is needed.
Compliance plans are specific to each tribe and
MUST be submitted to the correct tribal office
prior to beginning work on a project which is on Reservation land. In some cases, the compliance plan may need to be submitted two (2) weeks before work on the project begins.
